These Terms of Service govern your use of usarealtorsnearme.com and all services provided by USA Realtor. By accessing or using our platform, you agree to be bound by these terms. Please read them carefully.
USA Realtor is a lead generation and agent-matching intermediary. We connect prospective home buyers and sellers ("Consumers") with licensed real estate agents ("Agents") who have subscribed to receive leads in specific geographic territories. We are not a licensed real estate brokerage and do not provide real estate services directly.
Using our platform as a Consumer is free of charge. When you submit a lead form, you consent to:
•Being contacted by a licensed real estate agent assigned to your zip code.
•Receiving a phone call, email, or text message from that agent within approximately 4 hours of your submission.
USA Realtor does not guarantee that any particular transaction will close, or that you will be satisfied with any agent. You are under no obligation to work with the matched agent. You may opt out of further contact at any time by notifying the agent directly.
Real estate agents who join our network agree to the following:
Eligibility: You must hold an active, valid real estate license in good standing in the state(s) where you wish to receive leads. We reserve the right to verify your license and to suspend or terminate your account if your license lapses or is revoked.
Free Trial: New agent accounts receive a 30-day free trial period. No credit card is required to sign up, but payment information will be required prior to territory activation and subscription billing.
Subscription Fee: After the trial period, a monthly territory subscription fee applies based on the market(s) you cover. Pricing is displayed during the checkout process. Fees are non-refundable except as required by law.
Lead Volume: We make no guarantee of a specific number of leads per month. Lead volume depends on consumer demand in your territory and is inherently variable.
Cancellation: You may cancel your subscription at any time through your agent dashboard or by contacting us. Cancellation takes effect at the end of the current billing period. No partial refunds are issued.
Territory Exclusivity: Each territory (county or zip code) is assigned to one active agent at a time. If your subscription lapses and is not renewed within the grace period, your territory may be released and made available to other agents.
All agents are required to maintain an active real estate license. We may verify licenses through state licensing board databases. Agents found to be operating without a valid license will be suspended immediately and may not receive a refund for any portion of their subscription period.
You agree not to:
•Provide false or misleading information in any form or profile.
•Use the platform for any unlawful purpose.
•Attempt to circumvent our lead routing system to contact consumers outside the platform's process.
•Harass, spam, or repeatedly contact consumers who have not responded to initial outreach.
•Reproduce, resell, or distribute leads received through the platform to third parties.
USA Realtor provides its platform "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the platform will be error-free, uninterrupted, or that any particular result will be achieved.
To the maximum extent permitted by law, USA Realtor shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the platform, including but not limited to lost profits, lost leads, or failed transactions. Our total aggregate liability to you shall not exceed the total subscription fees paid by you in the three months preceding the claim.
Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached within 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association, conducted in Massachusetts. You waive any right to a jury trial or class action.
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions.
We reserve the right to update these Terms at any time. When we make material changes, we will update the "Last updated" date. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms.
